By using our websites, you agree to these Terms. We keep it simple: use the site respectfully, don’t do anything shady, and know that everything here—our content, photos, and products—belongs to our brand. If you disagree with anything here, please don’t use the site.

1) Eligibility & Age Restrictions

Our site is not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us information, contact us and we’ll delete it.

If you are 13–17, you may use the site only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. By using the site, you represent that you’re 18 or older or using it with parental/guardian consent.

We do our best to describe everything clearly, but we can’t guarantee every photo, scent description, or ingredient list will display the same on every screen.

  • All products are subject to availability. Prices may change without notice.

  • An order is considered binding once payment is received and you receive an order confirmation email.

  • We reserve the right to limit or cancel orders if we suspect fraud or misuse.

5) Intellectual Property

Everything on the site—including our name, logo, visuals, copy, and product designs—is the property of Oshun and protected by copyright and trademark laws.

  • Our trademarks are pending registration.

  • Please don’t reuse, reproduce, or modify anything without written permission.

6) User Content

If you tag us, leave a review, or comment on our site or social media, you’re giving us permission to share it (with credit) in our marketing or repost it online.

By submitting content, you grant Oshun a royalty-free, worldwide, irrevocable, perpetual license to use, reproduce, modify, publish, and display that content in connection with our brand.

If you would prefer not to have your content used, you may opt out at any time by contacting us.

We’ll never share your private info—just your words or content, with love.

7) Third-Party Tools & Links

We sometimes link to other websites or use third-party tools (like email signups or embedded video). These may have their own privacy practices. We’re not responsible for how those sites operate—use them at your own discretion.

8) Disclaimer & Liability

We work hard to make sure everything works properly, but we can’t guarantee perfection. Our site and products are provided “as-is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the site or products.

9) Your Promise to Us (Indemnity)

You agree to defend, indemnify, and hold Oshun harmless from any claims, costs, or liabilities that arise from your misuse of the site or violation of these Terms.

10) Dispute Resolution — Arbitration & Class-Action Waiver

Please read this section carefully—it affects your rights.

Most concerns can be resolved by contacting us. If we can’t resolve it informally, any dispute, claim, or controversy arising out of or relating to these Terms, the site, or our products will be resolved by binding arbitration on an individual basis.

Administrator & Rules: Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, including, where applicable, procedures for remote/virtual hearings.

Location & Conduct: Unless you and Oshun agree otherwise, the arbitration will be conducted by video conference or in Travis County, Texas.

No Class Actions: You and Oshun each waive the right to bring or participate in class, collective, consolidated, or representative actions. The arbitrator may award relief only to the individual party and only to the extent necessary to provide that party’s relief.

Small Claims Option: Either party may bring an individual action in small claims court instead of arbitration, if eligible.

Injunctive/IP Relief: This section does not prevent either party from seeking temporary or injunctive relief in court to protect intellectual property or secure the arbitration process.

Governing Law for Arbitration: The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration agreement.

You may opt out of arbitration within 30 days after you first agree to these Terms by contacting us with the subject line “Arbitration Opt-Out” and your full name and the email tied to your account/order.

11) Governing Law & Venue

Except as preempted by the FAA, these Terms and any non-arbitrable disputes are governed by the laws of the State of Texas, without regard to conflict-of-law rules. For any court proceedings permitted under these Terms (e.g., small claims or injunctive relief), the state and federal courts located in Travis County, Texas will have exclusive jurisdiction and venue, and you consent to personal jurisdiction there.

12) Severability & Updates

If any part of these Terms is found invalid or unenforceable, the rest still applies. We may update these Terms at any time, and we’ll update the date at the top when we do. By continuing to use the site, you accept any changes.
